Online Building Contracts

All building companies in NSW need to enter into compliant written contracts by law when preparing to carry out home or residential building work for a client that exceeds $1,000 in value.  A good building contract from the perspective of the builder should always comply with all legal requirements, seek to protect the builder, but also be drafted in a way that it is acceptable to the client as well.

Most builders usually buy standard building contracts in hard copy from associations or institutions, and not only does this cost approximately $30 to purchase per project (contracts in duplicate), but this also leaves little room for making changes to the standard hard copy building contract to suit the needs of the parties.  Other builders may engage their solicitor to draft a building contract from scratch, and although this building contract can be used over and over again, it can cost more than $5,000 in legal fees to have this done.

Where an association or institution does offer building contracts online, it usually involves paying a continual fee for each contract purchased and used in relation to each individual project, in order to generate a recurring income for the association or institution, rather than just paying a one-off fee and allowing the builder to use the building contract as many times as they like.
